To make a demand, as a condition

of the withdrawal of the shipping order, for an

undertaking, as suggested in the last paragraph

of (37), would be improper and most undesirable.

Moreover, as an estoppel against legal proceedings

which are pending or anticipated, such a course

of action would not have the required effect.
